2023 Waggle Golf 24-Hour Hole-In-One Challenge Skill Contest Rules (“Official Rules”)
This Waggle Golf 24-Hour Hole-In-One Challenge (the “Skill Contest”) is sponsored by:
- Waggle Golf LLC, 1973 County Road C2 W, Roseville, MN 55113 (the “Sponsor”)
Eligibility: The Skill Contest is open to anyone who physically participates in the Sponsor’s 24-Hour Hole-In-One Challenge at Loggers Trail Golf Course (11950 80th St N, Stillwater, MN 55082) from June 22-23. Employees, independent contractors, interns, officers, directors, and agents of Sponsor or any of Sponsor’s parents, subsidiaries, and associated companies are not eligible to win.
How to Enter: Beginning 6/22/2023 through 6/23/2023, participants may enter the Skill Contest by reserving a bay via donation to Special Olympics Minnesota, and attempting to hit a hole-in-one. Any participant found to have violated the Skill Contest format by participating without a confirmed bay reservation will be automatically disqualified.
Skill Contest Format: Participants reserve a bay for between 0.5 to 2 hours (maximum 4 participants per reservation). If a participant hits a hole-in-one, they are eligible to claim a Hole-In-One Prize. Hole-in-one must be confirmed by Sponsor.
Agreement to Official Rules: By entering the Skill Contest, you indicate your full and unconditional agreement to, and acceptance of, (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Entry in this Skill Contest does not constitute entry into any other promotion or contest. By entering this Skill Contest, you unconditionally accept and agree to comply with and abide by these Official Rules and all decisions of Sponsor which shall be final and legally binding in all respects.
Entry Period: Skill Contest begins at 7 a.m. Central Time on 6/22/2023 and concludes at 7 a.m. Central Time on 6/23/2023. Any attempt to participate in the Skill Contest outside of this period will not be eligible.
Winner Selection: If a participant is confirmed by the Sponsor to have hit a hole-in-one, they are eligible to claim a hole-in-one prize. Limit one (1) prize per participant.
Prize(s): Hole-in-one prizes will be awarded to any participant who is confirmed by Sponsor to have hit a hole-in-one during their designated bay reservation.
Description of Hole-In-One Prize:
Winners will receive one (1) $300 gift card to be used at Waggle’s online store (getyourwaggleon.com), as well as additional prizes contributed by additional Skill Contest partners.
General Conditions: In the event that the operation, security, or administration of the Skill Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, suspend the Skill Contest to address the impairment and then resume the Skill Contest in a manner that best conforms to the spirit of these Official Rules. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Skill Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Skill Contest may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor.
Release and Limitations of Liability: By participating in the Skill Contest, you agree to release and hold harmless Sponsor, its parent, subsidiaries, affiliates, the prize providers and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Skill Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Skill Contest; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage due, misdirected, or undeliverable mail; (e) errors in the administration of the Skill Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Skill Contest or receipt of , participation in, or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Skill Contest, and in no event shall the Released Parties be liable for attorney’s fees.
You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Privacy and Use of Information Submitted; Publicity: Any information you submit as part of the Skill Contest will be used for purposes of this Skill Contest and treated in accordance with Sponsor’s Privacy Policy except as otherwise set forth in these Official Rules. Except where prohibited, participation in the Skill Contest constitutes an entrant’s consent to Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Skill Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Minneapolis/St. Paul, MN. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Skill Contest, shall be governed by, and construed in accordance with, the laws of MN, without giving effect to any choice of law or conflict of law rules (whether of MN or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than MN.
